CCPA Privacy Notice
California Consumer Privacy Act notice for California residents describing your rights and our data practices.
This CCPA Privacy Notice (“Notice”) is provided by Seismic Swift AI, Inc. (“Seismic Swift AI”, “we”, “us”, or “our”) pursuant to the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA”). This Notice supplements our Privacy Policy and applies exclusively to natural persons who are residents of the State of California (“consumers” or “you”).
1.Scope
1.1This Notice applies to personal information collected by Seismic Swift AI about California residents in the context of our website at seismicswiftai.com, the Datum platform, and related services. It does not apply to personal information we process on behalf of our enterprise customers in our capacity as a service provider — those processing activities are governed by our Data Processing Addendum and the instructions of the relevant business customer.
1.2For the avoidance of doubt, personal information collected from employees, contractors, and job applicants of Seismic Swift AI in the context of the employment relationship is addressed in our separate Employee Privacy Notice.
2.Information We Collect (CCPA §1798.100)
In the preceding twelve (12) months, we have collected the following categories of personal information from California consumers:

2.1We collect personal information directly from you (when you register, contact us, or use our services), automatically (through cookies and server logs), and from third-party sources such as identity providers (Azure Active Directory, SSO providers) and publicly available professional data sources (LinkedIn, company websites) where you have made information available.
3.How We Use Information
We use the personal information described above for the following business purposes:
- Providing, operating, and improving the Datum platform and related services
- Processing transactions, billing, and subscription management
- Authenticating users and enforcing access controls and tenant isolation
- Sending transactional and service communications (account alerts, security notices, SLA reports)
- Responding to support requests, inquiries, and feedback
- Complying with legal obligations and enforcing our agreements
- Detecting and preventing fraud, abuse, and security incidents
- Conducting internal analytics to understand how our services are used (using self-hosted PostHog only)
- With your consent, sending marketing communications about products and services we think may interest you
3.1We do not use automated decision-making or profiling that produces legal or similarly significant effects on California consumers without providing an opportunity to opt out and obtain human review.
4.Your Rights Under CCPA
As a California resident, you have the following rights under the CCPA:
4.1Right to Know (§1798.100). You have the right to request that we disclose: the categories and specific pieces of personal information we have collected about you; the categories of sources from which we collected it; the business or commercial purpose for collecting, selling, or sharing it; and the categories of third parties to whom we have disclosed it.
4.2Right to Delete (§1798.105). You have the right to request deletion of personal information we have collected from you, subject to certain exceptions (e.g., information necessary to complete a transaction, detect security incidents, comply with a legal obligation, or enable solely internal uses that are reasonably aligned with your expectations).
4.3Right to Opt Out of Sale or Sharing (§1798.120). You have the right to opt out of the sale or sharing of your personal information. See Section 5 for our current practices.
4.4Right to Correct (§1798.106). You have the right to request correction of inaccurate personal information we maintain about you.
4.5Right to Limit Use of Sensitive Personal Information. We do not collect sensitive personal information as defined by the CPRA; this right is therefore not applicable.
4.6Right to Non-Discrimination (§1798.125). We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge different prices, provide a different level of service quality, or suggest that you may receive a different price or quality of goods or services as a result of exercising your rights.
4.7How to Submit a Request. To exercise your rights, submit a verifiable consumer request to privacy@seismicswiftai.com or by calling our toll-free number at (800) 555-0100. We will acknowledge your request within 10 business days and respond within 45 calendar days (extendable by an additional 45 days with prior notice if reasonably necessary). We may need to verify your identity before processing your request.
5.Do Not Sell or Share My Personal Information
5.1Seismic Swift AI does not sell your personal information to third parties for monetary consideration.
5.2Seismic Swift AI does not share your personal information with third parties for cross-context behavioral advertising. We use only self-hosted analytics (PostHog on our own Azure infrastructure) and do not use third-party advertising networks, pixels, or tracking technologies that would constitute “sharing” under the CPRA.
5.3We disclose personal information to our service providers (sub-processors) solely for business purposes. Such disclosures are not considered “sales” or “sharing” under the CCPA because these parties are contractually prohibited from using the information for any purpose other than providing services to us.
6.Authorized Agents
6.1You may designate an authorized agent to make a CCPA request on your behalf. To use an authorized agent, you must either: (a) provide the agent with written permission and verify your identity directly with us; or (b) provide the agent with power of attorney pursuant to California Probate Code §§ 4000–4465.
6.2We may deny a request from an authorized agent who does not submit proof of authorization. We may also require you to directly verify your identity with us even if you choose to use an authorized agent, except where you have provided power of attorney.
