Acceptable Use Policy
Standards governing responsible use of the Seismic Swift AI platform.
This Acceptable Use Policy (“AUP”) governs your access to and use of the Seismic Swift AI platform, APIs, SDKs, and related services (collectively, the “Service”) provided by Seismic Swift AI, Inc. (“Seismic Swift AI”). This AUP is incorporated by reference into and forms an integral part of the Terms of Service and any applicable Master Services Agreement. Capitalised terms not defined herein have the meanings given to them in the Terms of Service. Violation of this AUP may result in suspension, throttling, or termination of your access to the Service.
1.Permitted Use
1.1The Service is designed for professional use by qualified individuals and organisations in the energy, geoscience, petroleum engineering, environmental science, and related industries. Subject to the restrictions in this AUP and the Terms of Service, you are authorised to use the Service for the following purposes:
- a.Uploading, storing, processing, and analysing seismic and subsurface survey data in supported formats (SEG-Y, LAS, GeoTIFF, and other formats specified in the Documentation).
- b.Running AI-assisted workflows, including seismic denoising, horizon tracking, fault detection, anomaly detection, and carbon capture and storage (CCS) monitoring and injection surveillance.
- c.Accessing, reviewing, annotating, and approving AI-generated interpretation results through the human-in-the-loop review system.
- d.Exporting interpretation outputs in supported industry-standard formats (SEG-Y, LAS, GeoTIFF, PDF, and other formats specified in the Documentation).
- e.Integrating with the Service via documented APIs and SDKs for automated or semi-automated professional workflows within your organisation.
- f.Generating reports and visualisations from processed data for use in professional, regulatory, or investment contexts, subject to the disclaimer in Section 11.3 of the Terms of Service.
- g.Collaborating with other Authorised Users within your organisation through the Service's multi-user and team features.
2.Prohibited Conduct
2.1You shall not use the Service, directly or indirectly, for any of the following activities. These prohibitions apply to you and to all Authorised Users operating under your account.
2.1.1 — Security and Infrastructure Violations
- a.Attempting to gain unauthorised access to any systems, accounts, networks, databases, or data belonging to Seismic Swift AI or its other customers, including by exploiting vulnerabilities, credential stuffing, brute-force attacks, or social engineering.
- b.Probing, scanning, fuzzing, or testing the security, vulnerability, or resilience of the Service or any related infrastructure without Seismic Swift AI's prior written authorisation.
- c.Circumventing or attempting to circumvent authentication mechanisms, authorisation controls, tenant isolation boundaries, rate-limiting systems, or other security controls of the Service.
- d.Injecting malicious code, malware, ransomware, spyware, worms, trojans, or any other harmful or disruptive content into the Service.
- e.Conducting denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks against the Service or any related infrastructure.
- f.Intercepting, monitoring, or capturing network traffic, API communications, or data not intended for your account.
2.1.2 — Competitive and Intellectual Property Violations
- a.Using the Service or any outputs to develop, train, evaluate, benchmark, or improve any competing product, service, or machine learning model.
- b.Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, architecture, weights, hyperparameters, training data, or trade secrets of the Service or its underlying machine learning models.
- c.Attempting to extract, reconstruct, or infer Seismic Swift AI's proprietary model weights or architecture through systematic querying, model inversion, or membership inference attacks.
- d.Sublicensing, reselling, providing access to, or otherwise making the Service available to any person or entity other than your Authorised Users.
2.1.3 — Resource Abuse
- a.Intentionally generating excessive load on the Service through automated or scripted requests that exceed the rate limits and resource quotas applicable to your subscription tier.
- b.Operating botnets, scrapers, or automated agents that interact with the Service in a manner not authorised by the Documentation.
- c.Exceeding storage, bandwidth, pipeline concurrency, or compute limits applicable to your subscription tier in a manner that degrades the performance or availability of the Service for other customers.
2.1.4 — Legal and Regulatory Violations
- a.Any use that violates applicable local, state, national, or international laws or regulations.
- b.Processing data in violation of applicable data protection, privacy, or data localisation laws, including the GDPR, CCPA, and applicable sector-specific laws.
- c.Violating any applicable export control laws, economic sanctions programmes (including OFAC sanctions), or import/export restrictions.
- d.Using the Service in any jurisdiction where the Service is prohibited or restricted by applicable law.
3.Data Restrictions
3.1Authorised Data Only. You may upload to the Service only data for which you hold all necessary rights, licences, permissions, and consents to upload and process. You represent and warrant that you have the legal right to upload all data you submit to the Service and that such upload does not violate the intellectual property rights, privacy rights, or contractual obligations of any third party.
3.2No Sanctioned or Embargoed Data. You shall not upload or process data that is subject to U.S. export controls (including ITAR-controlled technical data or EAR-controlled items) or that originates from or relates to activities in jurisdictions subject to comprehensive U.S. sanctions (currently Cuba, Iran, North Korea, Russia, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine), unless Seismic Swift AI has provided prior written authorisation following appropriate compliance review.
3.3No Sensitive Personal Data. The Service is not designed or authorised for the processing of special categories of personal data as defined by GDPR Article 9 (e.g., biometric data, health data, genetic data, data concerning racial or ethnic origin) or of personal financial data, payment card data, or government-issued identity numbers, except to the extent expressly authorised in writing by Seismic Swift AI. You shall not include such data in Customer Data without prior written authorisation.
3.4No Malicious or Synthetic Data Designed to Degrade Service. You shall not upload data that is specifically designed or structured to exploit vulnerabilities in the Service's data parsing, storage, or processing infrastructure.
3.5Confidential Third-Party Data. You are solely responsible for ensuring that you have the contractual and legal authority to upload data owned by or relating to third parties, including data licensed from seismic data libraries, national data repositories, joint venture partners, or regulatory authorities.
4.Resource Limits
4.1The Service enforces rate limits and resource quotas to ensure fair usage and platform stability for all customers. The following limits apply per subscription tier:

4.2When a rate limit is reached, the API returns HTTP 429 (Too Many Requests) with Retry-After, X-RateLimit-Limit, X-RateLimit-Remaining, and X-RateLimit-Reset headers. API clients must implement exponential backoff with decorrelated jitter when handling rate-limit responses.
4.3Sustained or repeated violations of rate limits or resource quotas may result in temporary throttling, reduction of effective rate limits, or account suspension at Seismic Swift AI's discretion.
4.4Enterprise customers with requirements exceeding the standard resource limits may request custom limits by contacting sales@seismicswiftai.com. Custom limits must be agreed in writing and reflected in the applicable Order Form.
5.Monitoring
5.1Seismic Swift AI monitors usage of the Service for security, performance, abuse prevention, and regulatory compliance purposes. Monitoring activities include: automated analysis of API request patterns to detect rate-limit violations and anomalous behaviour; security event logging and alerting; resource consumption tracking; and audit trail maintenance as required by SOC 2 Type II controls.
5.2Seismic Swift AI's monitoring does not include accessing the content of Customer Data (seismic files, interpretation results) for purposes other than providing the Service, except: (a) as required to respond to a security incident; (b) as required by applicable law or court order; or (c) with Customer's explicit prior written consent.
5.3Seismic Swift AI may use aggregated, anonymised metadata (e.g., API call counts, feature usage rates, job completion rates) derived from usage monitoring to improve the Service, subject to the terms of the Privacy Policy. Such aggregated data does not identify individual customers or users.
5.4All monitoring activities are subject to the data protection obligations set forth in the Privacy Policy and, where applicable, the Data Processing Addendum. Monitoring data is retained in accordance with Seismic Swift AI's data retention schedules.
6.Enforcement
6.1Seismic Swift AI reserves the right to investigate and take appropriate enforcement action in response to any actual or suspected violation of this AUP, the Terms of Service, or applicable law. Enforcement actions will be applied proportionately to the nature and severity of the violation and may include:
6.2Seismic Swift AI may take immediate action, including account suspension, without prior notice where it reasonably determines that: (a) a violation poses an imminent risk to the security, integrity, or availability of the Service or of other customers' data; (b) criminal activity is suspected; or (c) continued access would constitute a violation of applicable law or regulatory requirement.
6.3You may appeal any enforcement action by submitting a written appeal to legal@seismicswiftai.com within fourteen (14) calendar days of the enforcement action. Your appeal must include: (a) a description of the enforcement action; (b) the grounds for your appeal; and (c) any supporting evidence. Seismic Swift AI will review the appeal and provide a written response within ten (10) business days.
6.4Enforcement actions taken under this AUP do not limit Seismic Swift AI's right to seek any other remedies available at law or in equity, including injunctive relief and damages.
7.Reporting
7.1Reporting Violations. If you become aware of any violation of this AUP by any person or entity, including by your own Authorised Users, you must promptly report it to security@seismicswiftai.com. Reports should include a description of the suspected violation, the date and time of the relevant events, and any supporting evidence.
7.2Responsible Disclosure Programme. Seismic Swift AI operates a responsible disclosure programme for security researchers. If you discover a potential security vulnerability in the Service, you are encouraged to report it to security@seismicswiftai.com before any public disclosure. Reports should include: a description of the vulnerability; steps to reproduce; potential impact; and your contact information. Seismic Swift AI commits to: acknowledging receipt within two (2) business days; providing an initial assessment within seven (7) business days; and providing safe harbour from legal action for good-faith security research conducted in accordance with this programme.
7.3Abuse Reports. To report abuse of the Service by third parties or to report content that violates this AUP, contact abuse@seismicswiftai.com. All abuse reports are reviewed by Seismic Swift AI's trust and safety team.
